A third follow-up following on from the hand-set locking post from Ewan’s meeting with the man from 3. Another quote:

Fergal: You shouldn’t be able to do this with the security measures we’ve put in place — this comes back to handset cost and my answer to your previous question.
It is possible to firmware-upgrade SIM-locked phones as far as I’m aware and some of the Three-issue firmware versions have known bugs so why can’t we be rid of them like other networks? Obviously, given the level of quality control 3 like to do pre-release they’d need to repeat their testing, but some updates should be possible… no?
